Can Your Minneapolis Duplex Tenant Have Guns and Ammo?

Someone recently asked me if they could do anything about their recent discovery that a tenant had an ample supply of guns and ammunition stored in the unit they were renting from her.

In a word, no.

While a private business may ban firearms on their premises, Minnesota statute 624.714 states, “A landlord may not restrict the lawful carry or possession of firearms by tenants or their guests.”

What about health and safety laws?

Last year the Minnesota state legislature passed a law requiring stored firearms to be either unloaded and equipped with a locking device, or stored in a locked firearm storage unit or room. 

Even though the landlord is the property owner, the tenant is entitled to their second amendment rights.
